Speaker and Deputy Speaker of National Assembly قومی اسمبلی کا اسپیکر اور ڈپٹی اسپیکر

نمبر ون :- کسی عام انتخاب کے بعد اور قومی اسمبلی اپنے پہلے اجلاس میں اور اپنے قومی اسمبلی کے ارکان میں سے ایک اسپیکر اور ایک ڈپٹی اسپیکر کا انتخاب کرے گی اور جتنی بار بھی اسپیکر یا ڈپٹی اسپیکر کا عہدہ خالی ہو ۔ وہ قومی اسمبلی کسی اور رکن کو اسپیکر اور ڈپٹی اسپیکر منتخب کرے گی ۔

(1) After a general election, the National Assembly shall, at its
first meeting and to the exclusion of any other business, elect from
amongst its members a Speaker and a Deputy Speaker and, so often as the
office of Speaker or Deputy Speaker becomes vacant, the Assembly shall
elect another member as Speaker or, as the case may be, Deputy Speaker.

نمبر 2 : – بطور اسپیکر یا ڈپٹی اسپیکر منتخب شدہ رکن اپنا عہدہ سنبھالنے سے قبل قومی اسمبلی کے رو برو جلد سوئم میں مندرج عبارت پڑھ کر اپنے عہدہ کا حلف اُٹھائے گا ۔ یعنی قسم کھائے گا ملک سے وفاداری کا ۔ اپنے سیاسی پارٹی سے وفاداری کا قسم نہیں کھائے گا ۔۔

Before entering upon office, a member elected as Speaker
or Deputy Speaker shall make before the National Assembly Oath in the
form set out in the Third Schedule.

نمبر 3 : – جب اسپیکر غیر حاضر ہو یا اسپیکر کا عہدہ خالی ہو یا کسی وجہ سے اپنے فرائض منصبی کی انجام دہی سے قاصر پو تو ڈپٹی اسپیکر بطور اسپیکر فرائض کی انجام دہی کرے گا ۔ اور اگر اُس وقت ڈپٹی اسپیکر بھی غیر حاضر ہو یا کسی وجہ سے بطور اسپیکر اپنے فرائض کی ادائدگی نہ کر سکتا ہو تو کوئی ایسا رُکن اسمبلی جس کا اسمبلی کے قوائد و ضبابط کی رو سے تیعُن کیا جائے ۔ اسمبلی کی اجلاس کی صدارت کرے گا ۔

3) When the office of Speaker is vacant, or the Speaker is
absent or is unable to perform his functions due to any cause, the Deputy
Speaker shall act as speaker, and if, at that time, the Deputy Speaker is
also absent or is unable to act as Speaker due to any cause, such member
as may be determined by the rules of procedure of the Assembly shall
preside at the meeting of the Assembly.

نمبر 4 :- اگر اسپیکر یا ڈپٹی اسپیکر کے عہدہ کی برطرفی کی قرارداد پر غور کیا جا رہا ہو تو اسپیکر یا ڈپٹی اسپیکر اسمبلی کی اجلاس کی صدارت نہیں کرے گا ۔

(4) The Speaker or the Deputy Speaker shall not preside at a
meeting of the Assembly when a resolution for his removal from office is
being considered.

نمبر 5 :- اسپیکر صدر کے نام پر اپنی دستخط شدہ تحریر کے ذریہ اپنے عہدے سے مستفی ہو سکے گا ۔

(5) The Speaker may, by writing under his hand addressed to
the President, resign his office.

نمبر 6 : – ڈپٹی اسپیکر اپنے اپنے اسپیکر کے نام اپنی دستخط شدہ تحریر کے ذریہ اپنے عہدہ سے مستفی ہو سکے گا ۔

(6) The Deputy Speaker may, by writing under his hand
addressed to the Speaker, resign his office

نمبر 7 : – اسپیکر یا ڈپٹی اسپیکر کا عہدہ خالی ہو جائے گا اگر وہ ۔۔ ۔

الف : ۔ وہ اپنے عہدہ سے مستفی ہو جاتا ہے ۔

Art No. 53 of Section 7 : – Says, The office of Speaker or Deputy Speaker shall become Vacant . . .

7 of A :- Says, If He, Speaker or Deputy Speaker Resigns his Office

ب : – وہ قومی اسمبلی کا رکن نہیں رہتا ہے ۔

7 of B :-He, Speaker or Deputy Speaker Ceases to be a member of the General Assembly …

ج : – اپنے عہدہ سے اسمبلی کی ایک قرارداد کے ذریہ برطرف کر دیا جائے ۔ جس کا کم از کم 7 دن کا نوٹس دیا گیا ہو اور جسے اسمبلی کی کل رُکنیت کی اکثریت کے دونوں سے منظور کیا گیا ہو ۔

7 of C :- He, Speaker or Deputy Speaker is Removed from Office by a Resolution of the General Assembly …

of which not less than seven days’ notice has been given
and which is passed by the votes of the majority of the total
membership of the Assembly.

نمبر 8 :- جب اسمبلی توڑ دی جائے تو اسپیکر اس وقت تک اپنے عہدہ پر برقرار رے گا جب تک کہ نئی منتخب شدہ اسمبلی کی طرف سے اس عہدہ کو پُر End Art No 53 کرنے کے لیے منتخب شدہ شخص اپنا عہدہ نہ سنبھال لے ۔

Art No. 53 of Section 8 : – Says, When the National Assembly is dissolved, the Speaker shall Continue in his Office till the another Person Elected to fill the Office. this Post.

By the Next Assembly enters upon his or her Office.

53. (1) After a general election, the National Assembly shall, at its

    office of Speaker or Deputy Speaker becomes vacant, the Assembly shall
    elect another member as Speaker or, as the case may be, Deputy Speaker.
54. نمبر 2 بطور اسپیکر یا ڈپٹی اسپیکر منتخب شدہ رکن اپنا عہدہ سنبھالنے سے قبل قومی اسمبلی کے رونرو اپنے عہدے کا حلف اٹھائے گاا ۔
55. نمبر 3 :- جب اسپیکر غیر حاضر ہو یا اسپیکر کا عہدہ خالی ہو یا کسی وجہسے اپنے فرائض منصبی انجام دہی سے قاصر ہو تو ڈپٹی اسپیکر بطور اسپیکر فرائض کی انجام دہی کرے گا اور اگر اسُ وقت ڈپٹی اسپیکر بحی غیر حاضر ہو یا کسی وجہ سے بطور اسپیکر اپنے فرائض کی ادائیگی نہ کر سکتا ہو تو کوئی ایسا رکن قومی اسمبلی جس کا اسمبلی کے قواعد و ضوابط کی رو سے تعین کیا جائے اسمبلی کے اجلاس کی صدارت کرے گا ۔

    28نمبر 4 : – اگر اسپیکر یا ڈپٹی اسپیکر کے عہدے کی بربرفی کی قرارداد پر غور کیا جا رہا ہو تو اسپیکر یا ڈپٹی اسپیکر اسمبلی کے اجلاس کی صدارت نہیں کرے گا ۔
    (3) When the office of Speaker is vacant, or the Speaker is
    absent or is unable to perform his functions due to any cause, the Deputy
    Speaker shall act as speaker, and if, at that time, the Deputy Speaker is
    also absent or is unable to act as Speaker due to any cause, such member

    (4) The Speaker or the Deputy Speaker shall not preside at a
    meeting of the Assembly when a resolution for his removal from office is
    being considered.
56. نمبر 5 : – اسپیکر صدر کے نام اپنی دستخت شدہ تحریر کے ذریعہ اپنے عہدہ سے مستفی ہو سکے گا ۔ ۔
    (5) The Speaker may, by writing under his hand addressed to
    the President, resign his office.
57. نمبر 6 : – ڈپٹی اسپیکر قومی اسمبلی کے اسپیکر کے نام اپنی دستخت شدہ تحریر کے ذریعہ اپنے عہدہ سے مستفی ہو سکے گا ۔
    1. نمبر 7 : – اسپیکر یا ڈپٹی اسپیکر کا عہدہ خالی ہو جائیے گا اگر وہ
    2. [ الف [ وہ اپنے عہدہ سے مستفی ہو جاتا ہے۔{
    3. ب { وہ قومی اسمبلی کا رکن نہیں رہتا ہے ۔ تو
    4. [ج{ ج { اُسے اسمبلی ے کے عہدے سے ایک قرار داد کے ذریعہ برطرف کر دیا جائے جس کا کم از کم سات دن کا نوٹس دیا گیا ہو اور جسے اسمبلی کی کل رکنیت اکسریت کے ساتھ ووٹوں سے منظور کیا گیا ہو ۔
       (6) The Deputy Speaker may, by writing under his hand
       addressed to the Speaker, resign his office

7) The office of Speaker or Deputy Speaker shall become
vacant if—
(a) he resigns his office;
(b) he ceases to be a member of the Assembly; or
(c) he is removed from office by a resolution of the Assembly,
of which not less than seven days’ notice has been given
and which is passed by the votes of the majority of the total
membership of the Assembly.

نمبر 8 :- جب اسمبلی توڑ دی جائے توقومی اسپیکر کا اسپیکر اس وقت تک اپنے عہدے پر برقرار رہے گا جب تک کہ نئی منتخب شدہ اسمبلی کی طرف سے اس عہدہ کو پر کرنے کے لیے منتخب شدہ شخص اپنا عہدہ نہ سنبھال لے ۔
(8) When the National Assembly is dissolved, the Speaker
shall continue in his office till the person elected to fill the office by the
next Assembly enters upon his office.
