Art 38 Constitution of Pakistan 1973 says about Promotion of social & economic well-being of the people عوام کی معاشی اور معاشرتی فلاح و بہبود کا فروغ کیسے ہو

38. Promotion of social and economic well being of the people 38. The State shall—

(a)  secure the well-being of the people, irrespective of sex, caste, creed or race, by raising their standard of living, by preventing the concentration of wealth and means of production and distribution in the hands of a few to the detriment of general interest and by ensuring equitable adjustment of rights between employers and employees, and landlords and tenants;

(b)  provide for all citizens, within the available resources of the country, facilities for work and adequate livelihood with reasonable rest and leisure;

(c)  provide for all persons employed in the service of Pakistan or otherwise, social security by compulsory social insurance or other means;

(d)  provide basic necessities of life, such as food, clothing, housing, education and medical relief, for all such citizens, irrespective of sex, caste, creed or race, as are permanently or temporarily unable to earn their livelihood on account of infirmity, sickness or unemployment;

(e)  reduce disparity in the income and earnings of individuals, including1persons in the various classes of the service of Pakistan; *

(f)  eliminate riba as early as possible 2[; and]

1[(g) ensure that the shares of the Provinces in all Federal services, including autonomous bodies and corporations established by, or under the control of, the Federal Government, shall be secured and any omission in the allocation of the shares of the Provinces in the past shall be rectified.]

39. The State shall enable people from all parts of Pakistan to

40. The State shall endeavour to preserve and strengthen fraternal relations among Muslim countries based on Islamic unity, support the common interests of the peoples of Asia, Africa and Latin America, promote international peace and security, foster goodwill and friendly relations among all nations and encourage the settlement of international disputes by peaceful means.

الف = : عام آدمی کے معیار زندگی کو بلند کر کے دولت اور وسائل ۔ پیداوار اور اس کی تقسیم کو چند اشخاص کے ہاتھوں میں اس طرح جمع ہونے سے روکا جائے گا ۔ اس لیے کہ مفاد عامہ کو نقصان نہ پہنچے اور آجر و ماجور یعنی نوکر چاکر اور زمین دار اور مزارع کے درمیان حقوق کی منصفانہ تقسیم کی ضمانت دی جائے گی ۔ بلا لحاظ جنس یعنی عورت اور مرد کا لحاظ کیے بغیر ۔ ذات پات کا لحاظ کیے بغیر اور مذہب یا رنگ و نسل کالحاظ کیے بغیر پورے عوام کی فلاح و بہبود کے حصول کی کوشش کی جائے گی ۔ ریاست اس کو اپنے طعی ممکن بنائے گی ۔

ب : – تمام شہریوں کے لیے ملک میں موجود ۔ دستیاب وسائل میں رہتے ہوئے ۔ موجودہ وسائل میں رہتے ہوئے ۔ ریاست اپنے عوام کو مناسب آرام اور معقول اور بنیادی ضرورت کی چیزیں اور مناسب روزی روزگار کی سہولتیں فراہم کرئے گی ۔

ج : – پاکستان کی ملازمت میں یا تمام ملازم ، تمام اشخاص کو لازمی معاشرتی بیمہ پالسی کے زریعے یا کسی اور طرح معاشرتی تحفظ مہیا کرے گی ۔

: د – ان تمام شہریوں کے لیے جو کمزوری یا بیماری یا بے روزگاری کے باعث مستقل یا عارضی طور پر اپنی روزی کما نہ سکتے ہوں ۔ ان کی مدد کی جائے گی ۔ ان کے ساتھ بلا لحاظ جنس یا ذات پات یا کوئی مذہب یا کسی رنگ و نسل کے بغیر ان کی مدد کی جائے گی ۔ ریاست اپنے بجٹ میں رہتے ہوئے اپنے عوام کی خوراک ہو یا لباس ہو یا رہائش ہو یا بنیادی تعلیم و تربیت ہو اور بنیادی مڈیکل کی سہولت ہو یہ سب چیز ریاست کی ذمہ داری ہے کہ وہ اپنے عوام کو پروموٹ کرے ۔

ز : = پاکستان میں ملازمت کے مختلف درجات ہیں ۔ یہ اشخاص سمیت ہر افراد کی آمدنی اور بنیادی کمائی میں عدم مساوات کو کم کرے گی ۔

ر = اور جتنی جلد ممکن ہو عدم مساوات کو ختم کرے گی ۔اور ا یک جیسا نظام بنائے گی سرکار ہماری ۔ حکومت ہماری ۔

آرٹیکل نمبر 38 کی وضاحت ہم کچھ اس طرح کرتے ہیں کہ

مملکت کی یہ کوشش ہوگی کہ وہ عوام کی معیار زندگی کو بلند کرے گی ۔ اور عمومی مفاد کے خلاف چند ہاتھوں میں دولت نہ رہے ۔

شہریوں کو معقول آرام اور فرصت کے ساتھ کام مناسب روزگار کی سہولیں بھی مہیا کی جائیں گی ۔ ایسے شہریوں کو قانونی ۔ بیماری ۔ یا بے روزگاری ، کی وجہ سے مستقل یا عارضی طور پر مزدوری کرنے اور کسب معاش کرنے کے قابل نہ ہوں ۔ انہیں بنیادی ضروریات زندگی اور بنیادی غذا اور لباس ۔ رہائش ۔طبی اور تعلیم مہیا کی جائے ۔

سودی کاروبار کا خاتمہ جلد از جلد ہوگا ان شاء اللّٰہ

ملک سے سودی کاروبار کو ختم کرنے کے لیے مختلف اقدامات بروئے کار لایا جائے گا ۔بلکہ سودی نظام کو آئینی طور پر ختم کیا جا چکا ہے ۔

حکومت کو آئینی اختیار حاصل ہے کہ وہ عوام کی معاشی اور معاشرتی فلاح وبہبود کے فوغ کے لیے سرکاری ادارے قائم کرے ۔ نیجی اور رضاکارآنہ طور پر کام کرنے والے اداروں کی امداد کر کے ان کی حوصلہ افزائی کی جائے گی۔
